1. Scope of Prototyping Services
Prototyping orders are intended for early-stage concept validation, design proving, and iteration. Prototyping parts are produced to standard tolerances and are not guaranteed to meet final production specifications. For guaranteed tolerances and performance, a Production order under 3DEO’s standard Production Terms & Conditions is required.
2. No Guarantee of Specifications
- All Prototyping parts are provided “as-is,” with all faults.
- Dimensional accuracy, cosmetic quality, and performance may vary.
- No warranties, express or implied, are provided, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
3. Printability & Failed Builds
- Certain geometries or designs may not be manufacturable or may result in sub-optimal or non-functional parts.
- 3DEO reserves the right to decline or cancel orders where designs are not manufacturable.
- At its discretion, 3DEO may attempt reprinting, but no refunds, credits, or replacements are guaranteed for failed builds or sub-optimal results.
4. Limited Liability
In no event shall 3DEO, Inc. be liable for any direct, indirect, punitive, incidental, special, or consequential damages, including loss of use or property damage, arising out of or connected with the use or misuse of prototype parts.
- 3DEO’s total liability is limited to the purchase price of the prototyping order.
- Any other remedy shall be in lieu of all other warranties or liabilities, regardless of cause.
5. Export Controls
3DEO’s activities are subject to U.S. export control and trade and economic sanctions laws (“Trade Controls”).
- Customers may not provide 3DEO with any data subject to ITAR.
- Customers must provide the correct Export Control Classification Numbers (ECCNs) for all data and parts. 3DEO is not liable for misclassifications provided by the customer.
- Customers shall comply with all applicable Trade Controls and indemnify 3DEO for any violations.
- 3DEO may terminate an order immediately to comply with Trade Controls.
6. Delivery & Shipping
Prototype orders are fulfilled on a quick-turn basis with estimated lead times only. Delivery dates are not guaranteed and may vary.
- Shipments are ExWorks – 3DEO unless otherwise agreed in writing. Title and risk transfer at 3DEO’s facility.
- Customers are responsible for all shipping, customs, duties, and import/export compliance beyond 3DEO’s facility.
7. Taxes
Customer is responsible for all applicable sales, use, excise, and other taxes associated with the purchase of prototype parts, except where Customer provides 3DEO with valid resale or exemption documentation prior to payment.
